What is a State Drug Trafficking Charge?

If the State of Florida is going to charge you or has charged you with drug trafficking, they will have to prove that you knowingly sold, purchased, manufactured, delivered, brought drugs into the state, or were in actual or constructive possession of an excess amount of a certain drug or drugs. Regardless of the type of drug, if you are charged with drug trafficking, it is a first degree felony and you will be facing a minimum and mandatory prison sentence, without the possibility of early release, and a mandatory fine.

Trafficking in Cannabis

You can be charged with trafficking for 25 pounds of cannabis or 300 or more cannabis plants.

Minimum Sentences for Trafficking Cannabis in Florida
  • 3 years in Florida State Prison and a $25,000 fine, for more than 25 pounds of cannabis, but less than 2,000 pounds or 300 plants of cannabis, but less than 2000 cannabis plants.
  • 7 years in Florida State Prison and a $50,0000 fine, for 2,000 pounds of cannabis or more but less than 10,000 pounds or 2,000 or more cannabis plants, but not more than 10,000 cannabis plants.
  • 15 years in Florida State Prison and a $200,000 fine, for 10,000 pounds of cannabis or 10,000 or more cannabis plants.
Trafficking in Cocaine

You can be charged with trafficking if it is an excess of 28 grams or more of cocaine or a mixture containing cocaine, but less than 150 kilograms of cocaine.

Minimum Sentences for Trafficking Cocaine in Florida
  • 3 years in Florida State Prison and a $50,000 fine, for 28 grams or more of cocaine, but less than 200 grams.
  • 7 years in Florida State Prison and a $100,000 fine, for 200 grams or more of cocaine, but less than 400 grams.
  • 15 years in Florida State Prison and a $250,000 fine for 400 grams or more but less than 150 kilograms.
  • Life in a Florida State prison, for 150 kilograms or more of cocaine.
Trafficking in Morphine, Opium, Hydromorphone, Salt, Heroin

You can be charged with trafficking for more than 4 grams of any of these drugs or 30 kilograms if it’s a mixture containing these drugs.

Minimum Sentences for Morphine, Opium, Hydromorphone or Heroin
  • 3 years in Florida State prison and a $50,000 fine, for 4 grams or more, but less than 14 grams.
  • 15 years in Florida State prison and a $100,000 fine, for 14 grams or more, but less than 28 grams.
  • 25 years in Florida State prison and a $500,000 fine, for 28 grams or more, but less than 30 kilograms.
Trafficking in Hydrocodone

You can be charged with trafficking hydrocodone for 14 grams or more.

Minimum Sentences for Hydrocodone
  • 3 years in Florida State prison and a $50,000 fine, for 14 grams or more, but less than 28 grams
  • 7 years in Florida State prison and a $$100,000 fine, for 28 grams or more, but less than 50 grams
  • 15 years and a $500,000 fine, for 50 grams or more, but less than 200 grams
  • 25 years and a $750,000 fine, for 200 grams or more, but less than 30 kilograms
Traficking in Oxycodone

You can be charged with trafficking oxycodone for 7 grams or more.

Minimum Sentences for Oxycodone
  • 3 years in Florida State prison and a $50,000 fine, for 7 grams or more, but less than 14 grams.
  • 7 years in Florida State prison and a $100,000 fine, for 14 grams or more, but less than 25 grams.
  • 15 years and a $500,000 fine, for 25 grams or more, but less than 100 grams
  • 25 years and a $750,000 fine, for 100 grams or more, but less than 30 kilograms.
